This Empureo Privacy Policy (or “Privacy Policy”) explains the practices and policies of Empureo LTD, (“Empureo”) regarding the collection and protection of Personal Data (defined below) supplied by users or collected by us from users of the Empureo software embedded in our app, Empureo products and Empureo website (the “Service”). By accessing or using the Service, you agree to comply with the terms and conditions of this Empureo Privacy Policy and Empureo may process (i.e., collect, use, etc.) your Personal Data as described in this Privacy Policy or in the Terms of Service. Empureo defines “Personal Data” as any data from which it is practical to directly determine the identity of an individual. This Privacy Policy is entered into in conjunction with the Empureo Terms of Service. This Privacy Policy may be updated by Empureo from time to time.

Empureo will provide notice of materially significant changes to the Privacy Policy by changing the Revision Date of this Privacy Policy, posting notice on its site(s), and/or sending a notice directly to users registered email address.

A user’s continued use of or access to the Service following such notice signifies the user’s intent to be bound to such change or changes.

What Information is Collected

We collect the following information when visiting our Site or when using the Empureo app.

Personal & Account Information

Information you provide during device setup of your Empureo Product(s), such as your email address, the location of each device, the type of mobile device used, WiFi SSID & Password, and the email addresses of any Shared users.

Information necessary to complete a purchase from our Site, including your name, billing and shipping address, credit card information, and other necessary information to complete your transaction. Your account username (email address) and password. 

 

Device Information

Audio and video (for applicable devices) is collected through the device. Audio and video data is stored securely on our servers to ensure you can access it and playback footage, such as the serial number, the device’s network information (including IP address), and device activity logs.

Information about your mobile device such as your mobile device ID (which is similar to a website IP address), device type, operating system, and mobile service carrier as well as your location if you activate automatic mode switching.

How Information is Used

We collect the information identified above and use it for the following purposes:

Provide user services and improve the Empureo Powered product’s functionality and to improve the user experience and enhance overall performance.

Operate your Empureo Service under your account and store your data.

Send you notifications through the Empureo app.

Send you communications and updates, which you can opt-out of.

To conduct research and analysis on how users’ access and use our Site, Service, and devices to help improve them.

Respond to your questions and concerns and better troubleshoot through our Customer Support Team (reachable at support@empureo.com).

Cookies and Passive Data Collection

Empureo automatically receives and records information on our server logs from your browser, including without limitation, your IP address, cookie information, and the page you request. Users should also be aware that other websites visited before entering the Service site(s) might place Personal Data within a user’s URL during a visit to their website, and Empureo has no control over such other websites.

Links to Third Party Sites

Our websites may contain links to other sites that are not under our control. These websites may or may not have their own policies regarding privacy. You should review those policies before visiting the websites. We have no responsibility for linked websites, and we provide these links solely for the convenience and information of our users.

Sharing Your Personal Information

We may share personal information collected through our Site with third-party service providers who act for or on our behalf. For example, we may use third-party vendors to design, operate, and/or host our Site, and to help us with our promotional efforts. These third parties may need information about you to perform their functions.

We will not, in any circumstances, share your personal information with other individuals or organizations without your permission, including public organizations, corporations or individuals, except when applicable by law or to otherwise protect our rights. We do not sell, communicate or divulge your information to any mailing lists.

Behavioural Advertising

As described above, we may use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you (Empureo products only.). Your Rights

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident, we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Online Tracking and Interest-Based Advertising

You may see our ads on other websites or mobile apps because we participate in advertising networks. Ad networks allow us to target our messaging to users considering demographic data, users’ inferred interests and browsing context.

These networks track users’ online activities over time by collecting information through automated means, including through the use of cookies, web server logs, web beacons and other similar technologies. The networks use this information to show ads that may be tailored to individuals’ interests, to track users’ browsers or devices across multiple websites, and to build a profile of users’ online browsing activities.

The information our ad networks may collect includes data about users’ visits to websites that participate in the relevant ad networks, such as the pages or ads viewed and the actions taken on the websites. This data collection may take place both on our websites and on third-party websites that participate in the ad networks. This process also helps us track the effectiveness of our marketing efforts.

Disclosures 

Empureo Partners and Affiliates

Empureo may disclose users’ Personal Data to third party business partners or affiliates who provide specific services to the user along with the Service (such as hosting or other support services). Such third-party business partner or affiliate may have their own privacy policies, and if Empureo discloses the third parties name to the user, it is your responsibility to read and adhere to such policies. However, if we disclose your Personal Data to a third-party business partner or affiliate that you are reasonably unaware of, then Empureo will require that such third party’s privacy policy is at least as strong as Empureo’s otherwise, users will be provided with a mechanism to opt-out of having their Personal Data viewed by such third parties.

 

Change of Ownership 

In the event of a change in ownership (including through bankruptcy), or a merger, acquisition or sale of assets with or to another entity, we reserve the right to transfer all of the Empureo user information, including Personal Data, to such separate entity. We will use commercially reasonable efforts to notify you (by posting on our site or an email to the email address you provide when you register) of any change in ownership, merger or acquisition of the Empureo Service assets by a third party, and you may choose to modify any of your registration information at that time.

Email Communications

The circumstances under which Empureo may disclose user electronic communications are when:

(i) it is necessary in order to provide the Service to the user;

(ii) it is necessary to protect the legitimate interests of Empureo, its users or third parties’;

(iii) it is required to cooperate with interception orders, warrants or other legal process that Empureo determines in its sole discretion to be valid and enforceable.

International Transfers

Personal Data may be stored and processed in the United Kingdom, or in any other country in which Empureo or its affiliates, subsidiaries or agents maintain facilities, and by using or accessing the Service, you consent to any such transfer of Personal Data outside of your country.

Security

Empureo uses industry standard security measures to protect against the loss, misuse and alteration of the information under our control. Although we make good faith efforts to store the information collected by the Service in a secure operating environment that is not available to the public, such as using SSL security measures, Empureo cannot guarantee complete security. Further, while we take reasonable steps to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” or “crackers” from obtaining this information.

Updating or Removing User Information

You may, at any time, choose to correct, update or remove the information you have submitted to Empureo by updating your account on our site. However, even if you terminate your account, bear in mind that you’re Personal Data and other information may be retained in our archive or backup records.
